Terms and Conditions

1) Who We Are

“Company,” “we,” “us,” and “our” mean ROCKSTAR LIFE HOLDINGS LLC operating XIMENA ZERMENO | GLOBAL LUXURY DESTINATION WEDDING PHOTOGRAPHER. “You” means the client.

2) Scope of Services

Destination wedding photography worldwide, including multi-day coverage, welcome/rehearsal events, wedding day, and post-wedding sessions. Optional: film/video, drone (where legal/safe), heirloom albums, reels, and content deliverables. Specific inclusions appear on your signed proposal and invoice.

3) Quotes & Pricing

Quotes are in USD and include applicable taxes unless stated otherwise. Travel and accommodations are not included and are billed to your destination(s) at cost unless already quoted. Custom proposals are tailored to your weekend; flat hourly rates apply for approved overage.

4) Payments & Invoices

  • 50% retainer to reserve your date(s).

  • Remaining 50% due 21 days before the first covered event.

  • Accepted: Stripe (major credit/debit cards), Apple Pay, Google Pay, wire/ACH (US).

  • Late balances may pause services/delivery until paid. Bank and platform fees are your responsibility.

5) No-Refund Policy

All payments are non-refundable. Dates are removed from our calendar when you book; we decline other work for your weekend. This is standard for destination events with complex logistics.

6) Satisfaction Guarantee (How it Works)

We stand by our work. If you’re not satisfied with the final delivered gallery, notify us within 7 days of delivery with clear notes. We will, at your choice:
a) complete a one-time re-edit round; or
b) schedule a make-good session (where feasible); or
c) issue a good-faith refund of service fees.
Except for option (c), the No-Refund policy remains in force. Travel/third-party costs are excluded from refunds. This guarantee requires full, timely payment.

7) 90-Day Promise (Delivery Commitment)

Unless your proposal states a different window, we promise to deliver your final, professionally edited photo gallery within 90 days of the last covered event; film edits (if included) follow the timeline in your proposal. If we miss the 90-day window (not due to your delay or force majeure), you receive either:

  • a service credit equal to one additional shooting hour for a future session, or

  • a rush album design upgrade.

    Choose one. This is our punctuality commitment.

8) Timelines & Cooperation

You agree to provide schedules, addresses, permits, venue rules, and primary contacts. We rely on your planner for timeline stewardship. Family photo lists must be provided 14 days before the event. Missed moments due to late arrivals, denied access, or venue restrictions are not our liability.

9) Artistic Direction

You hire us for our style. We guide when needed and disappear when not. RAW files are not delivered. Final curation, color, and black-and-white decisions are at our discretion. Reasonable editing requests are welcome during the re-edit round included in §6.

10) Rescheduling & Replacement

If your date moves and we’re available, we’ll transfer payments to the new date (fees may apply for season/weekday changes). If Ximena becomes unavailable due to illness/emergency, we will (a) provide a qualified associate shooter or (b) offer a refund of service fees at your option.

11) Permits, Drones & Restrictions

Where required, you (or your planner) secure permits and venue permissions. Drone use depends on local law, weather, and airspace. If rules prevent planned coverage, we adapt with equivalent alternatives.

12) Safety & Conduct

We maintain a calm, professional set. We may decline unsafe locations or conduct that risks people, gear, or venue property. We follow local laws and venue rules at all times.

13) Confidentiality, NDAs & Privacy

We respect your privacy, guests, and vendors. NDAs are available upon request. Client galleries are private by default. See our Privacy Policy for data practices. Sensitive events (celebrity/HNW, minors, religious rites) receive heightened discretion.

14) Portfolio Use (Opt-In)

We love to share beautiful work—but only with your consent. Portfolio, website, awards, and social usage are opt-in by default. If you opt in, we will credit collaborating vendors when known.

15) Intellectual Property & Copyright Transfer

Upon full payment, we transfer to you full ownership and copyrights to the final delivered photo files for personal use and printing. We may retain limited archival copies. Extended or commercial licensing (editorial/brand) can be added on request.

16) File Delivery & Archiving

Delivery is via secure online gallery. Please download and back up all files in at least two locations. We keep an archive for at least 12 months after delivery; long-term storage is not guaranteed unless contracted.

17) Revisions

Your project includes the re-edit option in §6. Additional edits beyond that are quoted. Raw capture reprocessing, heavy retouch, or complex composites are premium services.

18) Client Responsibilities

Provide accurate information, timely approvals, and access to locations. Arrange on-time glam and transportation. Assign a family wrangler for formals. Point us to must-have heirlooms and moments before the event.

19) Limits of Liability

To the maximum extent permitted by law, our total liability under this agreement is limited to the amount you paid for services. We are not liable for consequential or incidental damages, data loss after delivery, acts of third parties, or restrictions beyond our control.

20) Indemnity

You agree to indemnify and hold us harmless from claims arising from your breach of these terms, misuse of deliverables, or violations of venue/law not caused by us.

21) Force Majeure

No party is liable for delays or failure to perform due to events beyond reasonable control (e.g., extreme weather, natural disasters, strikes, acts of government, epidemics, travel bans, venue closures). We will communicate promptly and propose good-faith alternatives.

22) Governing Law & Venue [TBD]

23) Dispute Resolution [TBD]

Before filing a claim, both parties agree to good-faith negotiation. If unresolved within 30 days, we agree to mediation in [TBD location]. If still unresolved, disputes proceed in the venue named in §22. Each party bears its own fees unless the law says otherwise.

24) AI-Assist Policy

We may use reputable, privacy-conscious software to assist with culling, color reference, or organization. Creative choices and final editing are human-led. Client images are never used to train third-party models without written consent.

25) Entire Agreement & Changes

Your signed proposal, invoice, and these Terms form the entire agreement. Changes must be in writing and signed by both parties. If a clause is unenforceable, the rest still stands.

FAQs

Why are payments non-refundable?

Your date blocks our calendar, travel, and team. We decline other work for your weekend. Non-refundable payments keep scheduling fair and predictable for destination logistics. Our Satisfaction Guarantee still protects you after delivery (see §6).

How does the Satisfaction Guarantee work with “no refunds”?

You get three options within 7 days of delivery: a re-edit, a make-good session (where feasible), or a good-faith refund of service fees. Outside those options, payments remain non-refundable to protect reserved dates and hard costs.

What exactly is the 90-day promise?

We commit to deliver your final photo gallery within 90 days of the last covered event unless your proposal sets a different schedule. If we miss the window (not due to your delay/force majeure), you choose a service credit hour or rush album design.

Can we move our date?

Yes, if we’re available. Seasonal or weekday changes may carry fees. If we’re unavailable, we’ll help place a qualified associate shooter or, at your choice, refund service fees per §10. Travel penalties from airlines/venues are outside our control.

Do we get RAW files?

No. RAWs are working files and part of our creative process. You receive professionally edited, high-resolution images ready for print and sharing. Extended commercial/editorial licenses are available on request.

Who owns the photos?

Upon full payment, you receive full ownership and copyrights to the final delivered photo files for personal use and printing. We may keep archival copies. Commercial/editorial use can be licensed separately.

Will Ximena photograph our wedding personally?

Yes—Ximena leads a limited number of weddings per year. For multi-day events, trusted teammates cover second angles, film, drone, and content. If illness/emergency prevents her attendance, see the replacement options in §10.

What if weather or rules change our plan?

We adapt with equivalent, safe alternatives and will propose backups with your planner. For drones and restricted sites, we follow local law and venue rules. Force majeure terms are in §21.

Are NDAs available?

Yes. We can sign a reasonable NDA. By default, portfolio use is opt-in only. Your privacy and your guests’ comfort matter; see §13–14 and our Privacy Policy.

How are files delivered and stored?

We deliver via a secure online gallery. Please download and back up in two places. We archive for at least 12 months after delivery unless your contract specifies extended storage.

What payments do you accept?

Stripe (major credit/debit), Apple Pay, Google Pay, and wire/ACH (US). Balances must clear before we shoot and before delivery. Platform and bank fees are your responsibility.
